1. Introduction

Welcome to Paper AI ("we," "our," or "us"). This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and Paper AI ("Company") governing your use of our mobile applications ("Apps"), including TesCam Studio, Traffic.AI, and Elk Grove Parks. By downloading, installing, or using our Apps, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use our Apps.

2. License Grant

Subject to your compliance with the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and Use: Download, install, and use the Apps on your compatible mobile device for personal, non-commercial purposes.

3. Restrictions

You agree not to, and you will not permit others to:

• Reverse Engineering: Decompile, reverse engineer, disassemble, or attempt to discover the source code of the Apps.
• Modify: Modify, adapt, translate, or create derivative works based on the Apps.
• Distribute: Distribute, rent, lease, sell, sublicense, or otherwise transfer copies of the Apps to others without our prior written consent.
• Remove Notices: Remove, alter, or obscure any proprietary notices or labels on the Apps.

4. User Responsibilities

• Compliance with Laws: You agree to use the Apps in compliance with all applicable local, state, national, and international laws and regulations.
• Account Security: If an App requires an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Accurate Information: Provide accurate, current, and complete information when creating an account or using the Apps.

5. Termination

This EULA is effective until terminated by either party. We may terminate this EULA immediately without notice if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Apps and uninstall them from your device.

6. Intellectual Property Rights

• Ownership: The Apps and all related intellectual property rights are owned by us or our licensors. This EULA does not grant you any rights to our trademarks, logos, or other proprietary materials.
• Feedback: Any feedback, suggestions, or ideas you provide regarding the Apps are voluntary and will become our exclusive property without any obligation of confidentiality or compensation to you.

7. Disclaimer of Warranties

• As-Is Basis: The Apps are provided "as is" and "as available" without any warranties of any kind, either express or implied.
• No Warranty: We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• No Guarantee: We do not guarantee that the Apps will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

• No Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
  • Your use or inability to use the Apps;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any bugs, viruses, trojans, or the like that may be transmitted to or through our Apps by any third party.
• Cap on Liability: Our total liability for any claim arising out of or relating to this EULA or the Apps shall not exceed the amount you paid, if any, for accessing the Apps.

9. Indemnification

You agree to defend, indemnify, and hold harmless Paper AI and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this EULA or your use of the Apps.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under this EULA will be brought exclusively in the federal or state courts located in California, and you hereby consent to the personal jurisdiction and venue therein.

11. Changes to This EULA

We reserve the right to modify or replace this EULA at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the Apps after those revisions become effective, you agree to be bound by the revised terms.

12. Severability

If any provision of this EULA is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this EULA will remain in full effect.

13. Entire Agreement

This EULA constitutes the entire agreement between you and us regarding the use of the Apps and supersedes all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
